HR Daily Community terms of use
1. Background
The HR Daily Community is a forum conducted by HR Publications Pty Limited (HR Daily), publisher of www.hrdaily.com.au, for its members to discuss, debate and share their ideas and experiences. These terms of use apply to your membership and use of, and access to, the HR Daily Community.
2. Eligibility
You warrant that:
(a) all registration information you submit is truthful and accurate;
(b) you will maintain the accuracy of that information; and
(c) you are 16 years of age or older.
3. Content, use and moderation
3.1 You must not post text, files, images, photos, video, links or any other materials (Content) or use the HR Daily Community in a way that:
(a) may be an infringement of intellectual property rights;
(b) promotes or advertises goods, services, a business or a political agenda;
(c) includes any obscene, indecent, threatening or offensive language;
(d) may be defamatory, obscene, discriminatory, misleading or deceptive or otherwise unlawful;
(e) invades the privacy of another person including by:
(i) posting personal information about another person (including a photograph or video) without that person’s consent; or
(ii) collecting usernames or email addresses of others by electronic or other means for the purpose of sending unsolicited messages;
(f) bullies, intimidates or harasses any person;
(g) propagates computer worms, viruses or other types of malicious programs.
3.2 When posting Content on the HR Daily Community, you must treat the views of other members with respect.
3.3 Views, comments, opinions, statements in Content posted on the HR Daily Community are not necessarily those of HR Daily. However, Content will not be monitored or moderated prior to its appearance and HR Daily accepts no responsibility for the conduct of any user or member of the HR Daily Community, including any Content posted on the HR Daily Community by a member.
3.4 You may report any concerns regarding misuse of the HR Daily Community, including a breach of these terms, by contacting site administrator Jo Knox on (02) 9267 3800 or jo@hrdaily.com.au.
4. Privacy
4.1 The HR Daily Privacy Policy is available at http://www.hrdaily.com.au/policies.php . Except as expressly stated otherwise in these terms of use, it applies to the HR Daily Community. To the extent of any inconsistency between these terms and the HR Daily Privacy Policy, these terms prevail.
4.2 Your personal information and the IP address associated with Content posted by you is recorded. You agree that any information you have entered or posted, including personal information, may be collected, stored and used by HR Daily to assist HR Daily in enforcing these terms or otherwise in accordance with HR Daily’s Privacy Policy.
4.3 By using and accessing the HR Daily Community, you consent to HR Daily using your personal information from time to time to send you emails, including on behalf of its advertisers, to promote events, services and products. You may opt out of receiving these emails by cancelling your HR Daily Community membership.
5. Other terms
Use of the HR Daily Community is also governed by the Ning Terms of Service and it is a condition of these terms of use that you comply with them. These can viewed further down this page, beneath the "HR Daily Community terms of use". To the extent of any inconsistency between these terms and the Ning Terms of Service, the Ning Terms of Service prevail.
6. Liability
6.1 HR Daily is not responsible for the conduct, whether online or offline, of any user or member of the HR Daily Community.
6.2 To the extent permitted under the Competition and Consumer Act 2010, in no event will HR Daily be liable to you or any other person for any damages, losses, costs or expenses arising from your use of the HR Daily Community or any Content.
6.3 You indemnify HR Daily for any damages, losses, costs and expenses incurred by HR Daily arising out of your use of the HR Daily Community.
7. HR Daily intellectual property
7.1 HR Daily owns the intellectual property rights in the HR Daily name and logos and all Content posted on the HR Daily Community by HR Daily or its employees. Nothing in these terms of use confers on you or any member any ownership rights in that intellectual property.
7.2 You grant HR Daily a licence to use, modify, publicly perform, publicly display, reproduce and distribute Content you post on this website. This licence is non-exclusive, royalty-free, able to be sublicensed by HR Daily and worldwide.
8. Termination
You may terminate your membership of the HR Daily Community by logging in, clicking on "settings", and selecting the option at the bottom of the page.
HR Daily may:
(a) delete your profile;
(b) delete any Content posted by you; and
(c) terminate your membership,
for breach of these terms of use or for any other conduct which it considers to be inappropriate.
9. General
9.1 The agreement between HR Daily and you is governed by and must be construed in accordance with the laws of New South Wales, Australia. You unconditionally submit to the non exclusive jurisdiction of the courts of New South Wales, Australia.
9.2 HR Daily may amend these terms by substituting amended terms for the HR Daily Community. Continued use of the HR Daily Community following those amendments constitutes acceptance of those amendments.
The following Terms of Service apply to your use of this Network. You are solely responsible for your conduct and your content on the Network and compliance with these terms. By registering with us or using or browsing this Network, you acknowledge that you have read, understood, and agree to be bound by these terms. This Network is not directed to anyone younger than 16 and is offered only to users 16 years of age or older. Any person who provides their personal information through this Network represents that they are 16 years of age or older.

You also agree that these Network Terms of Service inure to the benefit of our service providers (including our Network platform provider) and that they may take action (including the removal of your content and disabling of your account) in order to maintain compliance with these Network Terms of Service. Technology and hosting for aspects of this Network are provided by this Network's online service provider. However, the Network Creator of this Network controls the content, membership and policy of this Network, including those pages served by such service provider on behalf of this Network. Notwithstanding anything to the contrary, by participating on this Network you agree to indemnify and hold harmless such service provider on all matters related to your interaction with others using this Network and participation with this Network.
