How many HR people have been asked to provide a policy when there was really only one person causing the 'problem'? 

Dress code, mobile phone use, internet use - any others that spring to mind?

Policy does however allow for a trigger for termination or discipline measures to take place. FWA will look very in-depth into workplace policy when they need to, and if you haven't got one I can guarantee they will ask why not, and side with an employee. Policies help take away the "I didn't know" defence.
